Since the 1960s, activists have pleaded for Lolita to retire from performing tricks in Miami Seaquarium. They also would like her to be relocated to an open-water pen. Unfortunately, she never got the chance to return to the sea.

The people who are Lolita's captors – the Dolphin Company - have ignored veterinary advice and continue to put her in danger. They are a danger to her health by forcing Lolita to perform for tourists. They push her to the limit with high-speed circles and head-first diving, which exposes her to chlorine and cause her to lose weight. In addition, they keep her in a tiny tank that is only one-and-a-half times the size of her natural habitat.

Fortunately, in 2022 the new owner of Miami Seaquarium pledged to work with an organization of Lolita advocates known as Friends of Toki and the Lummi tribe, who consider her to be a family member in a plan that would eventually take her to open waters. The plan would have included a sanctuary in Washington's west coast, where she could stay for the rest of her life, receive human care and be monitored by researchers. The sanctuary pen was planned to be hundreds of times larger than her Miami home and be was surrounded by ocean, but not concrete tanks.

If the plan was implemented, Lolita (also known as Tokitae or Toki) might still be alive today. In the wild, killers whales are social animals and bond with their family members until death. It is not known what health issues are affecting the orca, since her captor is not required to share this information. The Orca Project created a repository of necropsies taken from Sea World. This shows that kidney disease often plays a part in the deaths of orcas in captivity.

Despite these ongoing health concerns Many are hopeful that Lolita could be closer to a life in the wild than before. Seaquarium's new owner Seaquarium has stated his commitment to move the whale out of her tank into her home waters in the Pacific.
